UNGA draft resolution. An Indian delegate participating in the vote added that
the practice of death penalty was exercised only on the "rarest of occasions" in India and the country's laws contained provisions for suspending the death penalty in the cases of pregnant women. The delegate further said that in India death sentences must be confirmed by a superior court and the accused had the right to appeal to a superior court or the Supreme Court. Moreover, Supreme Court had uphold the death penalty of Pakistani national Kasab, the sole surviving gunman of the 2008 attacks on Mumbai. In October, Ministry of Home Affairs (MHA) also rejected mercy plea of Kasab. Earlier, the Maharashtra home department had also recommended to President Pranab Mukherjee to reject Kasab's mercy plea. Senior lawyer Ujjwal Nikam has welcomed the development, saying "President has to study the recommendation of MHA. It's a positive phase in the case. It's a good development." K Unnikrishnan, NSG martyr Major Sandeep Unnikrishnan's father, said, "I am happy that we did not make a mistake. I am very sure that President will take a decision very soon." Kasab had sent his mercy petition to President Pranab Mukherjee in September. Kasab's mercy plea was filed through the Arthur road jailor to the President's office. Kasab has been sentenced to death in the 26/11 case. If executed, Kasab will be the 52nd person to be hanged in India since independence. Ahead of him are people such as Mohammed Afzal Guru, the terrorist condemned to the gallows for his involvement in the December 2001 Parliament attack case, awaiting the President's decision on his mercy petition.


New York gold down for week on Recession, fiscal crisis fears

 Gold eased on Friday and posted a sharp weekly loss as signs of global economic slowdown and fears of a US recession dented bullion's inflation-hedge appeal. The metal posted a 1 percent drop this week and has fallen in five out of the past six weeks. News that the euro zone swung into a recession, disappointing US economic data and Federal Reserve Chairman Ben Bernanke's negative outlook on the housing recovery all kept pressure on gold.

Gold sagged as the S&P 500 equities index was on track for its largest two-week drop in about six months. Fears that the United States could lapse into recession if a combination of scheduled tax hikes and spending cuts is allowed to go forward weighed on all markets, analysts said. "The severity of the recent equities decline has cast a shadow of fear over gold investors that continued capitulation in the stock market will force leveraged accounts to sell gold," said Jeffrey Sica, chief investment officer of Sica Wealth, which manages over $1 billion in assets.

Spot gold edged down 0.2 percent to $1,712.60 an ounce by 3:04 PM EST (2004 GMT), after it hit a one-week low of $1,704 on Thursday. On the options front, heavy selling of a call spread between $1,700 and $1,670 an ounce for a low premium suggested dealers expected the market would not fall much lower, TD Bank precious metals strategists said in a note.

US equities edged up on Friday after Congressional leaders vowed to find common ground on taxes and spending that would allow them to head off the looming fiscal crisis after their meeting with President Barack Obama. Gold's safe-haven status could shine in the case of failed talks and political paralysis, analysts said. Extreme fears over the first fiscal crisis last year and a downgrade of the US credit rating ultimately sent gold to its record high of $1,920.30 an ounce in September.

Also underpinning gold was rising geopolitical tension in the Middle East due to escalating rocket attacks between Israel and Palestinian militants. US COMEX gold futures for December delivery settled up 90 cents at $1,714.70 an ounce. Trading volume was in line with its 30-day average, preliminary Reuters data showed. Silver dropped 1.1 percent to $32.22 an ounce.

PHYSICAL, INVESTMENT DEMAND EYED Gold fell this week after a report from trade group World Gold Council showed that global gold demand dropped 11 percent in the third quarter from record levels in the same period last year. Gold investment demand, however, remains resilient. Holdings of the SPDR Gold Trust, the world's No 1 gold-backed exchange-traded fund, rose to a level just shy of the record high hit in October. Platinum group metals also fell after the end of strikes that swept South Africa's mining sector. Platinum was down 0.9 percent to $1,555.74, while palladium dropped 0.8 percent to $623.97.

Expert appointed over Dr Savita Halappanavar Death





An independent expert has been appointed to investigate the death of pregnant woman Savita Halappanavar at University Hospital Galway.

Her family said she asked several times for her pregnancy to be terminated because she had severe back pain and was miscarrying.

Her husband told the BBC the termination was refused because there was a foetal heartbeat.

Her death led to a series of protests against Ireland's abortion laws.

About 2,000 people gathered outside the Irish parliament, the Dáil, in Dublin on Wednesday evening calling for the reform of the Republic's abortion laws.

Speaking in the Dail on Thursday, Irish Deputy Prime Minister (Tanaiste) Eamon Gilmore said it was time to bring "legal clarity" to the issue of abortion.

Mr Gilmore said the Irish government "is going to deal with this issue".

"I think the discussion needs to be a reasoned, dignified discussion," he said.

"What it is needed is to be bring legal clarity to circumstances that have been outstanding for a period of time."

During Wednesday night's protest, a minute's silence was held in memory of Mrs Halappanavar, 31, who was a dentist and was originally from India.

A group of about 40 protesters also gathered outside the Irish embassy in London. In Cork, a candlelight vigil was held at the city's opera house in her memory.

When asked by the BBC if he thought his wife would still be alive if the termination had been allowed, Mrs Halappanavar's husband, Praveen, said: "Of course, no doubt about it."

He said staff at the hospital told them Ireland was "a Catholic country".

Her death, on 28 October, is the subject of two investigations.

In a statement released on Wednesday evening, Ireland's Health and Safety Executive (HSE) said it would appoint an independent, external expert in obstetrics and gynaecology.

The HSE said the National Incident Management Team (NIMT) would oversee a review. The make-up of that team and its terms of reference are yet to be finalised.


University Hospital Galway will also carry out an internal investigation. It said it could not comment on individual cases but would be cooperating fully with the coroner's inquest into Ms Halappanavar's death.

In a statement released on Wednesday, the Galway Roscommon University Hospitals Group extended its sympathy to the husband, family and friends of Ms Halappanavar.

Dr Muiris Houston, health analyst for The Irish Times newspaper, said that all of the circumstances surrounding the incident had not been revealed yet.

He described it as a "rare situation".



The Indian ambassador to Ireland, Debashish Chakravarti, said his embassy was monitoring developments.

"We deeply regret that this lady died in the circumstances that she did and, of course, the death of any Indian national is a source of concern to us, I suppose," he said.

"Steps should be taken so that it doesn't happen to any other Indian citizen."

Abortion is illegal in the Republic except where there is a real and substantial risk to the life, as distinct from the health, of the mother.

In January, the Irish government established a 14-member expert group to make recommendations based on a 2010 European Court of Human Rights judgment that the state failed to implement existing rights to lawful abortion where a mother's life was at risk.

A spokesperson for the Department of Health said that group was due to report back to the Minister for Health, James Reilly, shortly.


"The minister will consider the group's report and subsequently submit it to government," the spokesperson said.

Mr Halappanavar is still in India after accompanying his wife's body there for her funeral.
